Amendment A Opponents File Briefs With the South Dakota Supreme Court

Two weeks after Amendment A’s legal team filed a motion to appeal a previous district court ruling that overturned voters’ approval of the measure, legalization opponents aligned with Gov. Kristi Noem submitted written arguments to the state’s Supreme Court.

The documents lay out a series of arguments that echo those made in the previous court proceedings. The opponents claim that Amendment A was a substantial “revision” to the South Dakota Constitution and that the initiative contained more than one subject. Both of these arguments have been rebutted by Brendan Johnson and other attorneys who are defending the voters’ decision last November.

The Supreme Court has not yet scheduled a date for oral arguments.
